Delivery and shipping terms
1. Scope of application
The following terms and conditions apply for all our offers and deliveries. Terms and conditions of purchase of the Purchaser or of the party ordering are binding for us if in each individual transaction we explicitly agree this in writing.
2. Offers
The entire offer and price lists are subject to change, errors, prior sales and availability. They are binding only if they have been expressly confirmed in writing by our company.
3. Delivery
We endeavour to deliver your orders as fast as possible. The delivery is based on the order in which the orders are received. Where possible, we take your desired delivery dates into consideration. To enable speedy deliveries, we reserve the right during the order processing to cut the packing sizes in to pieces (for eg. ordered quantity 1 x 500 g; delivery: 5 x 100g). In the case of size denominations, the ordered packaging size will be charged.
4. Delivery reservation
The entire offer is subject to availability. Due to the fact, that at the time of the brochure production, some of the varieties have still to be cleaned and checked, and despite all efforts these varieties will not be available for delivery.
5. Delivery and shipping terms
Austria: Shipping is at the expense of the customer / ordering person. For each order we charge the actual shipping / postal charges (rates as per the Online Shop). In the case of partial deliveries within Austria, due to delivery shortages there will be no additional shipping or postal charges. Orders of seedlings (set onions, shallots, potatoes, garlic, flower bulbs and peonies) are regarded as a separate order which will be sent and charged at extra costs.
EU and Switzerland, Liechtenstein, Iceland and Norway:
The actual shipping fees will be charged for foreign orders. Part deliveries in these countries need to be specifically pre confirmed and agreed. Additional shipping costs will be charged.
Other third countries:
Deliveries will exclusively be sent ex-work (EXW). In general, there are no deliveries for plant sets (onion sets, flower bulbs, potatoes) to other third countries.
6. Prices and terms of payment
All prices quoted in the brochure are NETT rates (in Euro), with the exception of books which include the Austrian VAT. ReinSaat GmbH invoices only in EURO with the application of the legal VAT.
With the release of the latest new brochure and the Online brochure, all previous prices and brochures lose their validity. Printing errors reserved.
Invoices are to be paid within 14 days after receipt of the goods without any deductions. ReeinSaat GmbH reserves the right for prepayments. Payments from abroad have to be without any fees for ReinSaat GmbH.
Commercial customers from the EU must indicate their VAT identification number when ordering. In case the VAT identification number is not mentioned, the Austrian VAT will be charged. In hindsight, the invoice cannot be changed.
7. Quality of the seeds
Our varieties consist exclusively of seed-fast varieties in BIO quality. Internal high-quality standards for purity and the germination capacity of our seeds complies with the statutory requirements concerning the respective variety and cultures. The actual examined germination capacity is indicated on the packaging. All our varieties are organic open-polinated seeds. These are not for direct consumption or for the production of sprouts.
8. Complaints and shipping damages
We can only accept complaints if they are the result of weight or calculation errors or confusion respectively mix up by ReinSaat GmbH. Liability for damages arising from inappropriate cultivation methods applied by the buyer are excluded. A legitimate claim for damages can only be asserted to the value of the calculated seeds. The batch number has to be stated in the case of complaints. For damages of products incurred during shipping, the logistic company or the Post needs to be contacted, respectively the delivery should not be accepted. An immediate contact with ReinSaat GmbH is required.
9. Right of withdrawal
Right of withdrawal: The right of withdrawal exists for contracts between ReinSaat GmbH and end consumers. The right of withdrawal does not exist for contracts between ReinSaat GmbH and other companies or organisations such as agricultural businesses, public corporations, societies and holdings. The withdrawal period is within 14 days from the day on which you or a third party other than the carrier as indicated by you acquired the material possession of the goods. The right of withdrawal does not apply to all special orders where an individual packaging of seeds is made on request of the client.
10. Return of goods
The return of goods is only possible in accordance with the remote sales act. Return agreements for goods must be agreed upon in writing and require our explicit consent. In the event of an agreed return of goods, the seeds have to returned without damage and in the original packaging to us. The seeds should not have been exposed to harmful weather conditions such as direct sunlight, rain, heat etc. The risk and the costs for the return of goods have to be paid by the buyer.
11. Reservation of ownership
All goods remain the sole property of ReinSaat GmbH until payment has been received in full including all surcharges. As long as the goods have not been paid in full, it is prohibited to sell, pledge or transfer by way of security the same.
12. Note
Without the prior written consent of ReinSaat GmbH, the purchased goods (seeds) may not be commercially multiplied, repacked or changed (for eg. pilled). The description and the properties of the sorts are based on experiences and should be used only for comparison. Depending on factors such as climate, weather, sowing period etc, the development of the plants can vary.
13. Severability clause
For every deviation of these Terms and Conditions to be valid, a written agreement is required. In case single conditions or regulations in the terms of use are invalid, this does not change the other conditions and regulations.
14. Place of performance and jurisdiction
All the rights and obligations arising from the businesses including payments, is A-3752 St. Leonhard as place of performance. The courts competent for St. Leonhard will have jurisdiction for legal disputes. This does not apply to sales to buyers within the EU.
