1. Scope of application:
The business relationship between the online shop of ReinSaat KG and its customers – hereinafter referred to as purchaser, buyer or customer – is subject exclusively to the following general terms and conditions in the version valid at the time of placement of the order.
2. Conclusion of contract
The assortment presented on the website of www.reinsaat .at is to be understood solely as an invitation to the customer to submit an offer. The contract with the online shop of ReinSaat KG is concluded as soon as the latter accepts it. For this purpose, an order confirmation is sent to the e-mail address stated by the customer. The dispatch of the goods ordered by the customer also leads to a conclusion of contract.

No separate order confirmation is sent for orders placed by mail or fax.
Solely the packaging quantities which are indicated in the online shop or the catalogue can be ordered. Quantities deviating from those require a separate written request.
Unless otherwise agreed, the delivery is effected to the address stated by the customer.
The entire offer is subject to availability. In the event that during order processing it becomes obvious that the ordered goods cannot be delivered immediately or not at all (shortages of stock, harvest failures or damages to the stored goods), the purchaser will be informed thereof without delay and notified about the expected delivery time. In such case, the purchaser can cancel the order or demand an immediate shipment of the available articles at the originally agreed shipping costs or wait for the delivery of all products.
We make a great effort to deliver your orders as fast as possible (according to the order of receipt). Where possible, we take you desired delivery dates into consideration. Nevertheless, delays in deliveries may occur in the main season (January to March) due to high order volumes.
4. Shipping within Austria
Shipping is the expense of the customer. A flat administration and shipping rate of € 5.50 (exclusive of VAT) is charged for every first order of the year. For further orders within the season we only charge the actual postage fees incurred. In the case of partial deliveries due to delivery shortages, the flat shipping rate of € 5.50 will be charged only once, at the first delivery. Since a flat shipping rate applies, no minimum order value is required for smaller orders. Orders of seedlings (set onions, garlic and flower bulbs) are regarded as a separate order which will be sent and charged extra (only postage fees) in accordance with the planting season.
Dispatch within EU and third countries The actual shipping fees are charged for foreign orders. We kindly ask commercial customers from the EU to indicate their VAT identification number when ordering (intra-Community supply of goods).
All prices indicated in the online shop are quoted including the legal VAT and exclusive of shipping fees, and are valid until end of November of the current year or until the release of the online catalogue of the subsequent year. Errors reserved.
6. Mode of payment
Invoices are to be paid within 14 days after receipt of the goods without any deductions. We reserve the right to withhold dispatch until receipt of payment. We also accept VISA and MasterCard. Crossed cheques are refused without exception; cash on delivery is also excluded. Please make sure that payments from abroad are effected without any fees for ReinSaat (please notify your bank that all bank transfer fees shall be borne by the customer).

7. Reservation of ownership
All goods are delivered by us under reservation of ownership and shall remain the property of ReinSaat KG until payment has been received in full.
The buyer is without or consent not allowed to propagate or modify (for example to pellet) the seeds for commercial purposes.
In accordance with these terms and conditions, every consumer is entitled to a right of withdrawal. A consumer is any natural person who enters into a legal transaction for a purpose that cannot be attributed to his or her commercial or freelance professional activity.
Right of withdrawal
You are entitled to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party other than the carrier and indicated by you have/has acquired the material possession of the last batch of goods.
To exercise your right of withdrawal, you must inform us (ReinSaat firstname.lastname@example.org, phone:+43 (0)2987 2347, fax: +43 (0)2987 2347 4) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
The right of withdrawal does not apply to the following contracts:
Contracts concerning the delivery of sealed goods which are for reasons of health protection and hygiene not suited for return, if their sealing has been removed following the delivery.
We can only accept complaints if they are the result of weight or calculation errors or a confusion. Liability for damages arising from inappropriate cultivation methods applied by the buyer is excluded. A legitimate claim for damages can only be asserted to the amount of the calculated seeds. The batch number has to be stated in the case of complaints.
10. Quality of the seeds
The purity and germination capacity of our seeds complies with the statutory requirements concerning the respective variety and, in general, exceeds prescribed values. The germination capacity which was examined in the year of dispatch is indicated on the packaging of the seed.
The variety descriptions and the cultivation information are based on available empirical values and have been prepared solely for comparative purposes. Depending on the development factors such as climate, weather conditions, planting time etc. the plants can develop differently.
